1. Acceptance of Terms
By accessing or using https://peregrinecargo.com (the “Site”) or engaging Peregrine Cargo (“Company,” “we,” “us,” or “our”) for transportation and related logistics services (collectively, the “Services”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site or our Services.
2. Scope of Services
We provide freight transportation solutions—including Dry-Van, Refrigerated, Truckload, and LTL shipments— as well as Lease-to-Own vehicle programs and other ancillary logistics‐support offerings. Specific service details (rates, transit times, equipment, and insurance) are confirmed in individual rate confirmations or written contracts (“Shipping Agreement”).
3. Quotes, Orders & Execution
- Quotes are valid for the period stated in the quote e-mail or, if unstated, for 7 calendar days.
- A Shipping Agreement is formed once you accept a quote in writing, via our customer portal, or via e-mail.
- Any change to origin, destination, weight, class, or service level may result in an updated rate.
4. Payment Terms
Unless otherwise agreed, all invoices are due net 30 days from invoice date. Late payments are subject to 1.5% interest per month (or the maximum rate permitted by law). You are responsible for all reasonable collection costs and attorney fees incurred in recovering overdue amounts.
5. Shipment, Title & Risk of Loss
Title and risk of loss transfer to you (the “Shipper”) upon delivery of the cargo to the carrier at origin. Our liability is limited to that provided under 49 U.S.C. §14706 (the “Carmack Amendment”) or as otherwise set forth in a written Shipping Agreement. For higher declared values you must request, and we must confirm, supplemental cargo insurance in writing.
6. SMS Terms & Conditions
6.1 Consent & Opt-In Method
You may consent to receive SMS messages from Peregrine Cargo by checking an unchecked opt-in box on our Contact or Sign-Up forms or by providing written consent in another documented format.
6.2 Message Types
SMS communications may include:
- Order confirmations and shipment tracking updates
- Delivery-schedule notifications or driver arrival alerts
- Customer-service follow-ups
- Occasional promotions or program announcements related to freight services
6.3 Message Frequency
We estimate sending 50 – 500 text messages per day across all users. Actual frequency received by any individual user will vary based on shipments and inquiries.
6.4 Fees & Charges
Standard message & data rates may apply, depending on your mobile carrier’s plan. Peregrine Cargo does not impose additional SMS fees.
6.5 Opt-Out & Help
- Reply STOP to any message to opt out immediately.
- Reply START to re-subscribe at any time.
- Reply HELP or e-mail office@peregrinecargo.com for assistance.
6.6 Data Privacy & Sharing
Phone numbers collected for SMS purposes will not be shared with third parties or affiliates for marketing under any circumstances. For details, please review our Privacy Policy.
6.7 Mandatory Disclosures (per CTIA/TCR)
“Message frequency may vary. Message & data rates may apply. Reply STOP to opt out; HELP for help. See our Privacy Policy and these Terms of Service for more information.”
7. Intellectual Property
All content on the Site—including text, graphics, logos, and software—is owned by or licensed to Peregrine Cargo and protected under U.S. and international IP laws. You may not reproduce, modify, or distribute this content without our prior written permission.
8. Disclaimer of Warranties
The Site and Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, Peregrine Cargo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Site or Services.
10. Indemnification
You agree to indemnify and hold harmless Peregrine Cargo, its officers, directors, employees, and agents from any claims, damages, or costs (including reasonable attorneys’ fees) arising out of your use of the Site or Services or your violation of these Terms.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law provisions. Any dispute shall be resolved exclusively in the state or federal courts located in Cook County, Illinois.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes take effect when posted here with an updated “Last updated” date. Continued use of the Site or Services after such posting constitutes acceptance of the revised Terms.
